Please read these Terms and Conditions carefully before using mariamchbazzi.com or engaging the services of MB Graphic & Photography Design, operated by Mariam Cheaitou Bazzi (“we,” “us,” or “our”). By accessing this website or booking a service, you agree to be bound by these terms.
1. Services Offered
MB Graphic & Photography Design provides professional photography and graphic design services, including but not limited to:
- Newborn, milestone, maternity, and family photography
- Branding design, web design, and print design
- Fine art prints available through our Pixels shop
2. Bookings & Agreements
All photography sessions and design projects require a signed client agreement and a non-refundable retainer fee to secure your booking date. The specific terms of each engagement — including deliverables, timelines, and payment schedules — are outlined in the individual client agreement provided upon booking.
3. Payments
Retainer fees are due at the time of booking and are non-refundable. Remaining balances are due as specified in the client agreement. We reserve the right to withhold delivery of final images or design files until payment is received in full. Prices are quoted in Canadian dollars (CAD) unless otherwise stated.
4. Cancellations & Rescheduling
We understand that life happens. Cancellations or rescheduling requests must be made as far in advance as possible. The retainer fee is non-refundable in the event of cancellation. Rescheduling may be accommodated subject to availability and the terms of your client agreement. Newborn sessions may be rescheduled without penalty within a reasonable window following your baby’s arrival.
5. Photography — Delivery & Usage
Final edited images are delivered within the timeframe specified in your client agreement, typically via an online gallery. All images are edited at the photographer’s artistic discretion. Raw or unedited files are not provided under any circumstances.
Digital images are provided for personal use only. Commercial use of any photograph requires a separate written license agreement. Please refer to our Copyright & Disclaimer Notice for full intellectual property terms.
6. Design Services — Ownership & Delivery
Upon receipt of full payment, the client receives a license to use the final agreed-upon design files for the intended purpose outlined in the project scope. Original working files, source files, and font licenses remain the property of MB Graphic & Photography Design unless explicitly purchased as part of the project agreement.
Any revisions beyond the number included in the agreed scope will be billed at our standard hourly rate.
7. Client Responsibilities
Clients are responsible for providing accurate project information, timely feedback within agreed timeframes, and any necessary materials (e.g., logos, copy, brand assets) required for design projects. Delays caused by the client may affect project timelines, for which we are not responsible.
8. Safety — Newborn Sessions
The safety and wellbeing of your baby is our absolute priority. All newborn posing is performed with professional training and care. We reserve the right to decline any pose or prop that, in our professional judgment, poses a risk to the baby’s safety. We also ask that all participants present during a session support a calm, safe environment.
9. Limitation of Liability
MB Graphic & Photography Design is not liable for any indirect, incidental, or consequential damages arising from the use of this website or our services. In the event of circumstances beyond our reasonable control (force majeure, illness, emergencies), we will make every effort to reschedule or provide an appropriate remedy. Our total liability to any client shall not exceed the total fees paid for the applicable service.
10. Website Use
You agree to use this website for lawful purposes only. You may not reproduce, distribute, or modify any content from this site without our prior written consent. All portfolio images, design work, and written content are protected by copyright law.
11. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Ontario.
12. Changes to These Terms
We reserve the right to modify these Terms at any time. Updates will be posted on this page with a revised effective date. Your continued use of this website or our services after any changes constitutes acceptance of the updated Terms.
